TERMS & CONDITIONS

1. DEFINITIONS
   
   • Buyer – the person named as the customer on the confirmation of order and invoice.
   • Seller – Jeevs T/A Love Cake, Hands worth, Birmingham. B21
   • Conditions – the terms and conditions as set out in this document and any special terms and conditions agreed in writing by the seller.
   • Goods – the articles/cakes which the Buyer agrees to buy from the Seller.
   • Price – the price for the Goods, excluding VAT and carriage or packaging.
   
   
   
2. CONDITIONS
   
   • A cake order will only be accepted if confirmed in writing five weeks before the function by the Client.
   • Exception is made for simple birthday cakes, fresh cream gâteaux / cakes orders which can be taken and made at short notice. Just ring through and enquire.
   • These Conditions shall form the basis of the contract between the Seller and the Buyer in relation to the sale of Goods.
   • All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods from the Seller pursuant of these Conditions.
   • Acceptance of delivery of the Goods shall be deemed to be conclusive evidence of the buyer’s acceptance of these conditions.
   • These Conditions may not be varied except by the written agreement of the Seller.
   • These Conditions represent the whole of the agreement between the Seller and the Buyer.
   
   
   
3. PRICE
   
   • The price shall be the price quoted on the Seller’s confirmation of order/invoice.
   
   
   
4. PAYMENT AND CONDITIONS
   
   • A minimum 30% deposit is required on placing the order, which is NON-REFUNDABLE. Payment of balance shall be due within 14 days before collection or delivery.
   • The Buyer shall pay all accounts in full and not exercise any rights of set-off or counter- claim against invoices submitted by the Seller.
   • All deposit cheques returned by the bank as “unpaid” will incur an administration charge of £15.00. The deposit and balance will then need to be paid in cash before the event.
   
   
   
5. GOODS
   
   • The quantity and description of the Goods shall be as set out in the Sellers confirmation Of order and submitted Seller’s design where appropriate.
   
   
   
6. WARRANTIES
   
   • The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller in the confirmation of order. Every care is taken to interpret the designs and match colours. But because our cakes and decorations are handmade, a perfect colour match and design interpretation cannot be guaranteed.
   • All our cakes leave our premises in good condition.
   • Sponge cakes to be eaten within two days and fruit cakes within fourteen days of Collection/delivery.
   • All our cakes have been made in a kitchen, which uses nut ingredients. But a nut free cake can be made and assured.
   • The number of servings per cake is only an approximate measure.
   
   
   
7. DELIVERY OF GOODS
   
   • Delivery of the goods shall be made to the buyers nominated delivery address as specified on the confirmation of order upon request otherwise goods are to be collected.
   • The buyer shall make all arrangements necessary with the wedding coordinator/Duty Manager to take delivery of the goods on the day notified by the Seller.
   
   
   
8. ACCEPTANCE OF GOODS
   
   • The buyer shall be deemed to have accepted the goods once they have been delivered or collected.
   • The buyer shall be invited to carry out a thorough inspection of the goods at an agreed time prior to Delivery or collection.
   • Any requested changes to the agreed design will be charged at a rate determined by the Seller.
   • The buyer shall carryout a thorough inspection of the Goods within 48 hours of delivery to the Nominated delivery address or collection. The Buyer shall give written notification and photographic evidence to the seller within five working days of delivery of the goods of any defects that a reasonable examination would have revealed.
   • Where the buyer has accepted, or been deemed to have accepted the goods, the buyer shall not Be entitled to reject Goods, which are not in accordance with the contract.
   
   
   
9. RISK
   
   • Risk shall pass to the Buyer on collection or on delivery of the goods to the nominated delivery address.
   • All items of equipment, including cake knife and stand, whether hired individually or provided as part of an overall package, is the responsibility of the client, and will be charged to the customer at full replacement cost if missing or damaged.
   • It is the customer’s responsibility to return all equipment. A deposit of GBP 100 is required and refunded on return. Any equipment not returned within 72 hours, will be classed as lost and deposit will not be refunded.
   • Should the client cancel less than ten days prior to the function, the full cost will be payable on demand.
